Bankruptcy
We view litigation as an adjunct to our restructuring practice. Our litigation services encompass analyzing and defending typical bankruptcy claims and related avoidance litigation. Additionally, we conduct major contentious insolvency litigation, including defense of leveraged buyout transactions, real property lease recharacterization, debt recharacterization, subordination (senior debt) provisions and guarantor liability. To enhance recoveries for our investor clients, we have successfully brought suits against officers, directors, and related third parties.
We have represented debtors, creditors’ committees, secured lenders, and other major players, including sources of new capital, in major reorganization cases throughout the U.S. In the course of formulating, negotiating, and documenting the often complex economic and legal solutions to business and personal insolvency problems, our lawyers have gained extensive experience in the litigation of Bankruptcy Code issues, conducted both in bankruptcy court and other venues. Our work in insolvency and bankruptcy law benefits from our wide-ranging skills in such areas as corporate, securities, tax, and pension law.
