Ching-Lee represents technology companies in patent litigation in the areas of electronics, computers, Internet transactions, telecommunications, medical devices, and chemical, mechanical, and consumer products. Her 14 years of patent litigation experience includes significant courtroom victories for clients, including at summary judgment. Ching-Lee’s successes include her summary judgment argument in the Central District of California that led to a Section 101 invalidity ruling in favor of a client that was recently affirmed by the Federal Circuit. Ching-Lee also is experienced in negotiating patent licenses and settlement agreements, providing client counseling on patent infringement and validity issues, and performing IP due diligence during the acquisition or sale of corporate entities.
- DealerTrack v. RouteOne – Successfully obtained summary judgment of invalidity against claims in all three asserted patents in a “bet the company” patent infringement action involving Internet-based automotive financing; Federal Circuit affirmed the invalidity rulings, including a Bilski invalidity ruling under Section 101.
- Supply Chain Connect v. Rhodia – Lead counsel in defense of Rhodia against patent infringement claims involving a business-to-business e-commerce clearinghouse for chemical suppliers.
- Defending a major consumer electronics company in multiple patent infringement actions involving electronic sale and transmission of music and video, fast booting of computer operating system, and real-time transaction processing.
- InMotion Imagery v. LG Electronics – Defending LG Electronics against patent infringement claims involving a video indexing system for DVDs.
- Spark Networks v. Humor Rainbow and Zoosk – Successfully obtained denial of a motion to dismiss on Section 101 Bilski grounds in a patent infringement action relating to online dating service.
- Philips v. Coby Electronics – Representing Coby Electronics in defense against a breach of patent license claim, and in assertions of tortious interference and unfair competition counterclaims, involving DVD player technology.
- Successfully obtained summary judgment of noninfringement and dismissal of patent action involving seat suspension systems in personal watercrafts for a worldwide leader in recreational vehicles and power sports engines.
- Syndia v. Gillette – Defended Gillette in a patent infringement action involving a three-week jury trial relating to plasma-enhanced physical vapor deposition process used in manufacturing MACH3 razor blades.
