E-DISCOVERY IN ACTION
Ropes & Gray has utilized E-Discovery in all aspects of litigation. Some of our more recent experience in which we successfully guided clients through complex E-Discovery issues includes:

Pre-Litigation Document Management Consultation —Litigation Readiness Plans
We have assisted clients in developing policies and plans to effectively manage multiple data sources across numerous offices. To do so, we have learned client systems, interviewed necessary personnel, researched applicable laws and regulations, and drafted and implemented document retention policies, data usage policies, and litigation readiness plans.

MDL/Pharmaceutical
A government investigation into an international pharmaceutical client’s drug pricing and marketing practices resulted in numerous state and MDL proceedings. Through E-Discovery negotiations and use of cuttingedge technology, we significantly reduced the initial estimate of over 300 custodians with approximately 25 million documents to three million documents. In so doing, we created a searchable repository that could be accessed throughout the various actions, reducing costs and streamlining complex discovery.

Complex Litigation and Regulatory Inquiries—Financial
In connection with multi-district civil litigation and regulatory inquiries concerning an investment adviser’s management of bond funds with exposure to so-called sub-prime mortgage investments, we collected and culled over two terabytes of data. Again, we reduced the amount of data requiring attorney review by 70%. The resulting review included over 20 million pages of fund documents — email communications, network data, accounting reports — as well as stored audio files, and resulted in the production of over 8 million pages to multiple parties in less than six months.

Data Intrusion
We have represented companies in connection with possible data intrusion issues. These matters typically require immediate mobilization to quickly preserve and collect transient and disperse quantities of data. Our E-Discovery team has hands on experience in the urgent technological attention these matters require.

IP Litigation
When a court ordered a Japanese client to produce electronic documents related to hundreds of different products within 10 days, in native and .tiff form, Ropes & Gray’s dedicated professionals met the court’s challenge. We collected 100 gigabytes of data and posted it to a secure server for production, all within the court’s deadline.
