Government Contracts
Our Government Contracts Litigation Practice extends beyond New England to include cases and clients across the country. We provide diverse litigation and counseling services to sophisticated defense and civilian contractors in both the for-profit and the not-for-profit sectors. Our recent work has addressed a range of government contract issues, including:
- State and federal government audits;
- Internal compliance system development and review;
- Assumptions of contract liabilities through business acquisitions;
- Suspension and debarment actions;
- Bid protests;
- Pricing and cost accounting disputes;
- Rights in technical data and software;
- Contract terminations;
- Performance disputes; and
- False Claims Act qui tam and direct government actions.
How We Help Our Clients
- We represent a large Mid-Atlantic academic medical center charged in a False Claims Act qui tam action with hundreds of millions of dollars in Medicare fraud for allegedly claiming anesthesiologists’ fees from Medicare for services that instead were performed by residents or nurses. Drawing upon the expertise of the firm’s health law group, we succeeded in convincing the court of our interpretation of complex Medicare regulations, which led to the dismissal of large portions of the case and a dramatic reduction of our client’s exposure.
- We have represented a gear manufacturer as a plaintiff against a large airframe manufacturer in a technologically complex case governed by principles of government contract and commercial law which involves allegations of fraud and economic duress as well as contract performance and breach.
- We successfully represented the manufacturer of the Patriot Missile against challenges to the performance of the missile during the Gulf War.
- We defended a commercial manufacturer against claims of fraud in connection with the pricing of government contracts for off-the-shelf items. Not only did our attorneys succeed in defending the client, but the First Circuit provided the first judicial definition of the scope of information required to be disclosed in the pricing of government contracts for commercial items.
- We advised a college in connection with Air Force contracts and grants for geophysical research conducted at Hanscom Air Force Base.
- We successfully defended against a government claim of latent defects in 2,000 jet engines.
- We advise a major Boston hospital in connection with contract and grant applications, protests, performance, and indirect cost questions.
- We advise another New England hospital on contract and grant work, from proposal through performance, administration, and closeout.
