Portfolio Evaluation and Management
Although certain patents or trademarks may hold special symbolic value, it is increasingly a company’s entire portfolio of intellectual property assets that shapes the company’s competitive and financial position. The Intellectual Property Group of Ropes & Gray is a leader in helping clients with the strategic management of their patent and trademark portfolios. Given our deep technical and scientific knowledge base, we are uniquely equipped to see the strategic value of individual IP assets, and how these assets work together to build differentiation and competitive edge in the marketplace.
We strategically evaluate patent portfolios, and recommend and implement worldwide strategies for patent prosecution in areas as diverse as biotechnology, electronic circuitry and Internet infrastructure and applications. We also provide strategic advice in building trademark portfolios.
Once the patents and trademarks are successfully prosecuted, the Intellectual Property Group has the resources to monitor our clients' rights and protect them against infringement. We regularly send protest letters to avert potential dilution of valuable trademark rights. Our attorneys also help clients evaluate the need to pursue litigation when rights disputes arise.
When clients seek to augment their IP positions through acquisition of rights, our team identifies and clarifies alternatives, such as acquiring a full portfolio, or pieces of a portfolio in certain jurisdictions. By combining an industry perspective and an understanding of how rights can be leveraged, our intellectual property attorneys foster better informed and more profitable rights acquisitions. We also work with clients as they divest all or a portion of their IP portfolios, structuring deals to maximize their value.
