Joan McPhee focuses her practice on white collar criminal defense and complex civil litigation. Joan has over two decades of experience representing multi-national and domestic corporations, financial institutions and hospitals, as well as officers, directors and other clients in criminal and civil litigation, enforcement actions, and federal and state grand jury investigations. Joan has helped clients resolve complex enforcement matters, including alleged health care and pharmaceutical fraud, securities and financial fraud, and public corruption matters. She also works closely with colleagues in our corporate practice, advising clients on the U.S. Foreign Corrupt Practices Act, the U.K. Bribery Act, and other related anti-corruption laws.

Prior to joining Ropes & Gray, Joan served as an Assistant United States Attorney and Deputy Chief of the Appeals Unit in the U.S. Attorney’s Office for the Southern District of New York. As a federal prosecutor, she investigated and tried cases involving a wide range of criminal conduct, including financial fraud, obstruction of justice, labor racketeering, and organized crime.

A member of the Policy Committee since 2008, Joan also served for many years as Chair of the firm’s Government Enforcement Practice Group and chaired the firm's Diversity Committee from 1994-2001.

Representative Clients and Matters

  • Lead counsel representing major pharmaceutical company in wide-ranging criminal investigation into fraudulent sales, marketing and pricing practices that concluded with a favorable, agreed-upon resolution for the company.  
  • Lead counsel representing health care insurer in high-profile public corruption investigation that concluded with a non-prosecution disposition.  
  • Lead counsel representing major defense contractor in grand jury investigation involving the alleged illegal export of military equipment that was resolved, after a five-year criminal investigation, with a civil settlement.
  • Lead counsel representing national hospital system in ongoing Department of Justice investigation and parallel qui tam litigation.  
  • Lead counsel representing former president of a pharmaceutical company in off-label investigation that concluded with no charges being brought against the executive.  
  • Lead counsel representing senior executive in USAO/SEC accounting and tax fraud investigation that concluded after a five-year investigation with no criminal charges being brought against the executive.  
  • Ongoing representation of companies and private equity firms in FCPA enforcement matters and in the design and implementation of anti-corruption compliance programs.
