Ken focuses on insurance coverage advice and disputes and the defense of complex business, tort, and property damage cases. With more than 30 years of litigation and counseling experience, Ken frequently serves as national coordinating counsel for leading national and international insurers to resolve major natural-catastrophe and international litigation, property damage cases, and casualty and professional indemnity controversies. Leading coverage cases he recently won at both the trial and appellate levels include Catlin Ltd. v. Imperial Palace, 600 F.3d 511 (5th Cir. 2010); Six Flags, Inc. v. Westchester Surplus Lines, 565 F.3d 948 (5th Cir. 2009); SR Int’l Business Ins. Co. Ltd v. World Trade Center Properties, LLC, 467 F.3d 107 (2nd Cir. 2006); and Port Authority of New York and New Jersey v. Affiliated FM Ins. Co., 311 F.3d 226 (3rd Cir. 2002).
- Natural Catastrophes—Lead first-party counsel in coverage matters and dispute resolution for London, Bermuda, and U.S. insurers in connection with earthquake, flood and named storms, and other catastrophes.
- September 11, 2001—Lead first-party counsel for London and Bermuda insurers in responding to claims and litigation arising out of terrorist attack, including the successful defense of London insurers in the $3.5 billion World Trade Center litigation.
- Asbestos in Buildings—Lead counsel in the successful defense of a $1 billion first-party property claim by the Port Authority of New York and New Jersey.
- Chemical Solvents—Lead counsel in the successful jury trial defense of third-party FELA coverage claims by major American railroads.
- Jewelers Block—Lead counsel in U.S. litigation involving multi-national disputes over international diamond transactions.
- Professional Indemnity—Coordinating counsel for London insurers in connection with tax shelter lawyer liability claims, litigation of contract rescission, and RICO exposure.
- Environmental Claims—National coordinating counsel and defending litigations against first-party property policies, including cases in the states of New York, New Jersey, California, and Washington.
- Contingent Commissions—Lead counsel for Lloyd’s syndicates in defense of recovery actions.
- Computer Controversies—National coordinating counsel for the London Market and acting in matters involving first-party property placements and date-recognition in computer systems.
- Railroad FELA Claims—Coordinating and defending coverage cases for London insurers in Florida, Ohio, Washington, D.C., Virginia, and Maryland involving claims against national railroad systems for asbestos, noise-induced hearing loss, and repetitive strain.
- Y2K Issues—National coordinating counsel for the London Market and acting in matter involving first-party property placements and date-recognition in computer systems.
- Personal Injury—Advising about coverage and defending cases in Texas and elsewhere that present claims for coverage as business torts.
- Property Damage—Defending claims and cases in Massachusetts and elsewhere involving alleged physical damage, business interruption, and extra expense.
- Bodily/Personal Injury—Defending cases that assert bodily or personal injury caused by insured entities.
