Practice
Ken Herman is a partner in Ropes & Gray's Intellectual Property Group. He has been a partner since 1978. He litigates in all technological areas. Ken tried his first lawsuit as an intern in law school, and has been trying cases ever since.
Professional Experience
Ken has tried cases for such clients as Aventis, Polaroid, BASF, Corning, Cognex, Fisher Controls, Forest Laboratories, Massachusetts Eye & Ear Infirmary, Philips Electronics, Lewmar and Tessera. Ken's cases have involved technologies as diverse as sail boat winches, optical waveguide fibers, semiconductor packaging, treatment for age-related macular degeneration and recombinant DNA. Ken has litigated in state courts, federal courts, and the International Trade Commission. He recently won a jury verdict for the Massachusetts Eye & Ear Infirmary, pursuant to which the Infirmary has already been paid over 125 million dollars, and royalties are on-going. Ken has also argued numerous appeals before the Court of Appeals for the Federal Circuit.
