Rich has a wealth of experience representing companies in patent litigation relating to consumer electronics devices, medical devices, financial systems and Internet-related technologies. Rich’s client base ranges from small companies to large established businesses throughout the country.

Rich is also involved in client rights counseling in non-litigated matters. His broad range of IP experience includes advising companies on patent portfolio management helping them grow their patent portfolios. Rich’s experience in intellectual property-related transactions includes negotiating exclusive and nonexclusive licenses, joint development agreements, software development agreements (including website development agreements) and other agreements.

In addition to ex parte patent prosecution, Rich handles adversarial matters in the U.S. Patent & Trademark Office, including administrative appeals and recently introduced inter partes reexamination proceedings. Rich has substantial international IP law experience working with many foreign patent offices, and has assisted clients with foreign opposition proceedings, invalidity appeals, advisory opinions and other proceedings.

Rich has studied numbers of patents that clients either wanted to enforce against competitors, were concerned about having used against them, or were considering acquiring. In many of these situations, Rich has provided thorough written opinions to clients. In other situations, he has responded to clients’ less formal needs by supplying carefully considered oral advice.

Representative Matters and Clients
  • Prosecute Rovi's world-wide patent and trademark portfolio and perform due diligences on target portfolios that it is considering acquiring or licensing. Licensing includes interactive program guide technology to multichannel operators, such as cable and satellite television providers, and consumer electronics manufacturers, as well as video recorder scheduling technology under brands such as VCR Plus. We also represent or have represented Rovi in a number of patent infringement suits, and provide counsel in connection with law suits and ADR proceedings abroad.
  • Premier Networks, Inc. v. Lucent Technologies Inc. and AT&T Corp. (Fed. Cir.) – Represented Lucent and AT&T in a case relating to electronic telephone circuits decided by a summary judgment in favor of Lucent and AT&T and affirmed by the Federal Circuit.
  • VLT, Inc. v. Lucent Technologies Inc. and Tyco Electronic Power Systems, Inc. (Fed. Cir.) – Represented Lucent and Tyco in appeal to the Federal Circuit. Achieved a consented-to judgment of non-infringement after a favorable Markman ruling.
  • Wedding Channel.com, Inc. v. The Knot, Inc. - We represented WeddingChannel in an action in the Southern District of New York for infringement of WeddingChannel’s patent relating to an Internet-based gift registry system and method, and for violation of federal and state computer fraud and abuse statutes.
  • Represented Transmeta in a number of inter partes reexaminations requested for Transmeta’s patents by Intel
  • Represented Motorola in requesting reexamination of a number of patents owed by RIM.
