Ryan M. Malone is Counsel in the Government Enforcement Group of Ropes & Gray LLP. He joined the firm in 2002 and focuses his practice on white-collar criminal litigation, complex civil litigation, and internal investigations.

Ryan represents parties in criminal and civil litigation at all levels of the federal courts, in grand jury investigations, and in other enforcement actions. He regularly assists clients in conducting internal reviews and investigations and in negotiating agreements with the Department of Justice and other governmental authorities. Recently, Ryan was the principal author of the successful petition for certiorari and the winning merits briefs in a landmark double jeopardy case before the Supreme Court that led to our client’s acquittal on all counts. See United States v. Yeager, 129 S. Ct. 2360 (2009).

Ryan is a nationally recognized advocate in the field of gaming law and has served on the faculty of the ABA's annual conference on gaming law. He has represented gaming clients around the world in suits in criminal, civil, and regulatory matters. In 2010, Ryan was appointed co-chairman of the Federal Regulation Committee of the ABA Section on Gaming Law.

Representative Clients and Matters

  • Representation at trial, on appeal, and before the Supreme Court of former executive at Enron Broadband Services, eventually resulting in victory at United States Supreme Court on double jeopardy grounds.
  • Defended chairman of the world’s largest Internet sportsbook in federal court on charges of illegal gambling, RICO, fraud, and tax charges.
  • Lead counsel representing defendant in the Jack Abramoff investigation on multiple felony charges resulting from acceptance of allegedly inappropriate gifts and meals. Representation resulted in dismissal of all felony charges and a misdemeanor plea.
  • Represented the Navajo Nation of Indians in civil RICO action in D.C. federal court seeking to recover coal royalties from utility companies.
  • Defended a major pharmaceutical company in federal court on alleged violations of the False Claims Act and various state laws.
  • Defended a major cargo airline in proceedings before the Department of Justice and in federal court relating to price-fixing of fuel surcharges.
  • Represented an international shipping company in various regulatory matters relating to tariffs, compliance with Office of Foreign Asset Control regulations, and other issues.
  • Represented member of the West Memphis Three, charged with multiple murders and awaiting execution in Arkansas, in his successful post-conviction effort to be freed from prison.
