Tom is a patent litigator working on complex intellectual property matters and has participated in patent trials and appeals in technologies ranging from to computer hardware to pharmaceuticals. Recently, Tom has applied his background in molecular biology and biochemistry towards a focus on Hatch-Waxman and medical device litigation.

Representative Matters and Clients

  • Purdue Pharma, L.P. v. Endo Pharmaceuticals, Inc.: Appeal of judgment that three patents relating to Purdue’s controlled release oxycodone formulations were infringed but unenforceable. Judgment of unenforceability reversed on appeal and remanded for further proceedings.
  • In re OxyContin Antitrust Litigation, (for Purdue Pharma, L.P.): Bench trial adjudication that three Purdue patents in suit were not unenforceable due to alleged inequitable conduct.
  • Purdue Pharma Products L.P. v. Par Pharmaceutical, Inc.: Bench trial adjudication that Purdue patents relating to controlled release tramadol formulations were infringed and enforceable. Affirmed on appeal.
  • Purdue Pharma, L.P. v. Ranbaxy Inc.: Ongoing ANDA litigation involving Purdue’s patents relating to a lowered level of impurities in controlled release oxycodone formulations.
  • Genzyme Corp. v. Anika Therapeutics, Inc. / Genzyme Corp. v. Seikagaku Corp.: Ongoing litigation involving Genzyme’s patents relating to hyaluronic acid-based viscosupplements.
  • King Pharmaceuticals, Inc. v. Teva Parenteral Medicines, Inc. / King Pharmaceuticals, Inc. v. Sandoz Inc.: Ongoing ANDA litigation involving King’s patents relating to automatic injectors for epinephrine.
