Briana Fasone is an associate in the firm’s data, privacy, and cybersecurity group based in New York. She advises a range of clients facing complex privacy and cybersecurity issues in litigation, transactional, and counseling matters. Briana assists companies across industries comply with federal and state privacy regimes, recently helping clients navigate issues related to the California Consumer Privacy Act (“CCPA”) and Video Privacy Protection Act (“VPPA”).

During law school, Briana served as a research and teaching assistant to Professor Herbert Hovenkamp, concentrating on antitrust law, and completed a judicial internship with the Honorable Jane R. Roth of the United States Court of Appeals for the Third Circuit. Before her legal career, she worked as a writer and leverages her prior journalism experience to help provide Ropes & Gray clients with clear advice on privacy and cyber matters.

Experience

  • Member of litigation teams representing corporate defendants against data misuse allegations, including VPPA complaints
  • Advises financial services companies on new and forthcoming privacy and cybersecurity regulations, including SEC and FTC requirements 
  • Conducts diligence of key data issues in transactions and assisted with privacy diligence in TPG’s $2.2 billion acquisition of Change Healthcare’s claims editing business, ClaimsXten
  • Developed privacy notices and information security policies for investment advisers and healthcare companies, as well as a restaurant chain and pro bono client
  • Counseled a software company on its response to a data breach
