Deanna Barkett FitzGerald

Associate

Dee FitzGerald handles a wide range of civil litigation, internal and government investigation, and appellate advocacy matters involving consumer protection laws, historical misconduct claims, contract disputes, and constitutional law for corporate and institutional clients. Dee also maintains an active pro bono practice, successfully representing clients in matters involving federal voting rights and constitutional challenges to state actions, as well as representing low-income clients in Section 8 benefits matters before state courts and administrative agencies.

Prior to joining the firm, Dee served as a law clerk for the Honorable Rya W. Zobel of the U.S. District Court for the District of Massachusetts. She also served as an assistant attorney general in the trial division of the Massachusetts Attorney General’s Office, where she represented public agencies and their employees in civil rights and tort claims in both state and federal court.

Dee has always been dedicated to public service and helping underserved populations. During law school, Dee represented children in neglect and uncared-for proceedings in the New Haven Superior Court for Juvenile Matters. Prior to law school, Dee worked in city, state, and federal government, including for the City of Boston’s Host Committee for the 2004 Democratic National Convention, as a policy aide to former Massachusetts attorney general Tom Reilly, and as a policy advisor to former U.S. Congressman Marty Meehan.

Experience

  • Represents religious institution investigating and resolving allegations of historical misconduct.
  • Represents national sports league in lawsuit alleging consumer protection, fraud, and other common law claims.
  • Represents hospitals in reimbursement appeals at the Provider Reimbursement Review Board and in federal district court.
  • Served as trial counsel for international fitness company defending breach of contract and M.G.L. c. 93A claim in federal district court in Massachusetts.
  • Represented board of international school in an independent investigation regarding faculty misconduct.
  • Won settlement in lawsuit on behalf of non-profit organizations against multiple Massachusetts state agencies over alleged failures to provide voter registration services in accordance with the National Voter Registration Act.
  • Successfully represented three national medical organizations and six physicians in widely followed First Amendment challenge to Florida law that prevented doctors from speaking freely with patients about gun safety, securing a favorable ruling from the U.S. Court of Appeals for the 11th Circuit, sitting en banc.
