Preparatory Committee approves list of Candidate Judges
At the sixth Preparatory Committee meeting on July 10, 2014, the Committee approved a list of candidate judges deemed suitable by the Advisory Panel to judge the Unified Patent Court. All of the judges who expressed interest will receive a letter from the Committee in the coming weeks detailing their submission outcome. Training sessions for the selected judges are expected to begin in the fall at the official Training Center in Budapest.

The Committee also approved the Financial Regulation and held initial discussions on legal aid, the rules of the Administrative Committee, the rules of the Budget Committee, and the process between the transitional to operational phase of the UPC. See the Committee’s Report here.
Spain’s second challenge to the UPC
On July 1, 2014, the Court of Justice of the European Union (CJEU) heard the second legal action brought by Spain, challenging the legality of the new UPC. The CJEU Advocate General is expected to give his opinion on October 21, 2014, with the Court expected to render its final decision towards the end of the year. The first action was denied in April 2013. Preparations for the court are being made in Europe as if this second challenge will also be denied; but we won’t know with certainty until the decision is handed down.
