Anatomy of a Data Security Breach: The Intersection of HIPAA and State Data Breach Notification Laws

This teleconference will cover issues that arise in a data security breach—specifically those that fall under the new federal data security breach provisions under the HITECH Act (for breaches of protected health information) and the corollary state breach notification laws (applicable to breaches of personal information). Topics include compliance, notification requirements, and practical considerations such as costs and potential liability, as well as steps for mitigating and responding to security breaches. We will also touch upon some of the recent changes to HIPAA under the HITECH Act that are relevant to electronic health information and to the data systems containing such information.
