Keith Wofford, business restructuring partner and co-managing partner of Ropes & Gray’s New York office, will participate in Practising Law Institute’s program titled “Recent Developments in Distressed Debt, Restructurings and Workouts 2018”. The program will be held in New York City on January 31, 2018.
Topics discussed will include issues relating to structuring, drafting and enforcing the rights of creditors and parties to loans, executory contracts and inter-creditor agreements, principally in out-of-court restructurings, exchange offers and pre-managed Chapter 11 bankruptcy filings.
Mr. Wofford will speak on a panel titled “Pre-negotiated Chapter 11 Plans,” which will consider:
- Cross-affiliate Setoff and Netting
- Documentation and contractual language; Lehman (Intel)
- Application of the automatic stay and exceptions for financial contracts – SemCrude, Metavante (Lehman), Swedbank, and SIPA v. UBS (Lehman)
