On October 12, IP litigation counsel Evan Gourvitz presented on the panel entitled “The Limits of First Sale in Trademark Law: Upcycling and Material Alternation” at the Center for Intellectual Property x Innovation Policy conference on First Sale: The Role of IP Rights in Markets.
The panel explored the trademark first sale doctrine, which provides that purchasers of genuine goods bearing trademarks are free to do what they want with those goods, including to re-sell them. In particular, the panel considered to what extent this doctrine does or should apply when goods have been materially altered.
