The Massachusetts Appeals Court recently affirmed a lower court judgment in favor of Ropes & Gray client Targus Group International, Inc. The unanimous decision affirmed an award of damages for breach of contract and the assessment of statutory interest, which together now exceed $6 million. The March 5 decision is the latest in a dispute going back to Targus’s 2000 acquisition of Roundhouse. Targus and Roundhouse agreed to mediate their dispute, and entered into an Agreement in Principle in July 2004 settling their dispute. Targus sued to enforce the Agreement in Principle, and the case turned on whether such agreement was binding and enforceable. Targus prevailed on summary judgment in the lower court, and that decision was affirmed by the Appeals Court. Partner Richard Batchelder led the Ropes & Gray team representing Targus.
