Washington, D.C.-based antitrust partner Mark Popofsky, chair of Ropes & Gray’s antitrust practice group, published an article titled “Patent Assertion Entities and Antitrust: Operating Company Patent Transfers,” in ABA’s The Antitrust Source. The article was subsequently reviewed on the patent law blog Patently-O and referenced as “required reading for the regulators at the FTC and DOJ,” on June 3, 2013.
In “Patent Assertion Entities and Antitrust: Operating Company Patent Transfers,” Mr. Popofsky and Mr. Laufert outline antitrust issues engendered by “patent privateering” stratagems, wherein operating companies sell their patents to “patent trolls” who then engage in costly litigation against the companies’ competitors.
