Health care partner Thomas Bulleit (Washington, D.C.) authored an article appearing in Law360 on Sept. 22 examining the government’s recent False Claims Act suit in the U.S. District Court for the Central District of California against certain physician-owned distributors (PODs) and their physician and non-physician owners. The article, titled “Ominous Outlook for Physician-Owned Distributors,” explains that the filing represents the first time that POD investigations have prompted a government suit based on the theory that investment returns were unlawful kickbacks.
