On April 26, the Journal of Law and the Biosciences published a report by life sciences senior counsel Alan Bennett (of Washington, D.C.) that proposes a new model for the FDA regulation of drug promotions. The model proposed is designed to account for the First Amendment rights of manufacturers without compromising the agency’s commitment to the protection of public health. The report was written in collaboration with Freddy Jimenez, the assistant general counsel at Johnson & Johnson, and Larry Fields, the senior director of clinical development for Janssen Pharmaceuticals.
