The article, titled “‘Reverse Patent Trolls’: Patent Law’s Newest Strategy Unfolds” is the tenth installment in an ongoing series of PTAB-related articles drafted by Ropes & Gray attorneys, and examines the strategy and goals motivating the filing of IPRs by parties that would not typically be participants in patent disputes.
Specifically, the article identifies two primary goals: defense against overbroad patent ownership assertions and financial gain, as the primary drivers of IPR activity initiated by parties not typically associated with patent disputes, and analyses the legislative and judicial defense options available to patent holders.
