Life sciences partner Kellie Combs (Washington, D.C.) was quoted in a Nov. 9 Law360 article regarding constitutional concerns related to off-label drug communications at a public hearing held by the U.S. Food and Drug Administration (FDA).
In testimony on behalf of the Medical Information Working Group, Ms. Combs noted that the Federal Register notice announcing the FDA hearing lacked any reference to the First Amendment, which suggests that the FDA may be unwilling to accept the limits imposed by the Constitution.
