Intellectual Property Litigator Quoted in ANA Magazine on Legal Rules for Marketers Sharing Social Media Materials

Intellectual property litigation counsel Evan Gourvitz (New York) was quoted in a Jan. 24 Association of National Advertisers’ ANA Magazine article on the legal guidelines marketers should follow when sharing copyrighted materials and popular Internet-spread images, or memes, on social media.

Evan explains that the laws governing copyright and other IP apply to social media just as they do in any other realm. He adds that marketers should have a candid risk-versus-reward conversation with their clients about the benefits of using protected content in social media, and should explore the possibility of seeking approval, or licensing the materials at issue, before using a celebrity photo, video, or popular meme.
