An IP litigation team achieved a victory in a post-grant review proceeding before the Patent Trial and Appeal Board for patent owner GREE, Inc., a Japanese mobile social and gaming company, against petitioner SuperCell.
On Jan. 16 the PTAB denied institution of the PGR brought by SuperCell under Section 101 and 112 patent eligibility grounds. This is the second of four GREE PGRs that Ropes & Gray is defending. Last year, the IP litigation team obtained denial of institution for the first PGR. A PTAB institution decision in the third and fourth PGR is pending.
