IP litigation partner Matt Rizzolo (Washington, D.C.) is quoted in a Bloomberg Law article published Feb. 14 on the U.S. Supreme Court’s decision to hear Return Mail v. U.S. Postal Service, which will consider whether the government is a “person” who may petition to institute review proceedings under the America Invents Act.
Mr. Rizzolo explains that the Supreme Court might be looking beyond the AIA. There are a number of other statutes that use “person” and do not clarify whether that includes the government. The Court could use this case to clarify those standards.
