The SEC announced on Dec. 22 that it had finalized reforms under the Investment Advisers Act to modernize rules that govern investment adviser advertisements and payments to solicitors. Asset management partner Jason Brown is quoted in a Dec. 23 FundFire article titled “SEC Adopts Revamped Advertising Rule,” on the newly adopted rule as it relates to private funds. While the “principles-based approach” in the final rule might be more welcome to the private funds industry than the previous version featuring “prescriptive advertising rules,” the requirements will take some adjusting to, said Jason. “Time will tell if any of those additional requirements will have a material effect on the manner in which sponsors market their private funds.”
