In a Law360 article, mergers & acquisitions partner and practice leader Chris Comeau analyzed dealmaking strategy in an economic downturn and how companies and investors can stay active in a bear market, identifying areas of opportunity and measures that can help ensure deals get done.
Chris explained that in a recession, as stock prices fall, companies look inward as they think about how they can get more financial performance out of their assets. These "portfolio rationalizations" can result in potential divestitures, spinoffs or other partnerships.
He also notes that a bear market is an opportunity for activist investors to start agitating in companies large and small where they're relatively more likely to have someone willing to listen.
