In Practical Law China’s June 2023 GC Agenda, life sciences partner Katherine Wang commented on China’s Detailed Implementing Rules on the Regulations on the Administration of Human Genetic Resources (HGR Implementing Rules). The rules were released on 26 May 2023 are effective from 1 July 2023.
According to Katherine: "The long-awaited rules may ease the administrative burden for life sciences companies that intend to conduct research on Chinese biological materials or non-genetic information derived therefrom. On the other hand, the rules clearly indicate the government's desire to potentially block outbound transfers of Chinese HGR if such transfer is perceived to jeopardize China's national security. How the government interprets national security concerns remains a critical question for multinational life sciences companies operating in China."
