Lawyers associated with patent monetization firm IP Edge are facing possible ethics inquires after Delaware federal Judge Colm Connolly said they used “shell” companies to obscure involvement in several patent lawsuits and referred the lawyers to the US Justice Department, the US Patent and Trademark Office and state lawyer ethics offices.
In a Managing Intellectual Property article, IP litigation partner Matt Rizzolo discussed the implications of Judge Connolly’s opinion highlighting the importance of parties having information about who is behind litigation.
“If I were to see an entity who seemed to be playing shell games with how they assigned or allocated responsibility for the patents in suit, I think it’s worth referring to this opinion. Lawyers might uncover that a patent owner doesn’t have standing,” said Matt.
