In Intellectual Asset Management and Global Competition Review, IP litigation partners Kevin Post, Steve Pepe, Matt Rizzolo and IP litigation associate Ryan Brunner examined the rise in standard essential patent (SEP) related investigations at the International Trade Commission (ITC).

The authors note that with evolving SEP policies in the United States and a global push by SEP owners for injunctive relief as leverage in license negotiations, the ITC is becoming—and is likely to remain—a popular forum for SEP litigation.
