In an Associated Press article, partner Michael Littenberg, global head of the firm’s ESG, CSR and business and human rights practice, discussed the U.S. Securities and Exchange Commission voluntarily staying its recently adopted climate disclosure rules pending the completion of judicial review by the Court of Appeals for the Eighth Circuit. In the days following their adoption, challenges to the rules were brought in six federal appellate courts. The petitions were consolidated for review in the Eighth Circuit.
Michael said that voluntary stay is unlikely to be a factor in the ultimate fate of the SEC rules. “While some companies may delay efforts to comply with the SEC’s measure, it’s not pencils down on climate disclosure more generally,” said Michael.
