In a Law360 article on the most notable midyear copyright decisions, IP litigation partner Matt Rizzolo discussed the only copyright case the U.S. Supreme Court considered this term.
In the Warner Chappell Music et al v. Sherman Nealy et al case, the justices ruled that the Copyright Act "includes no time limit on monetary recovery," provided a plaintiff files a timely claim.
Matt explained that the ruling expands the potential for lawsuits, but it does not address when a copyright claim accrues and the viability of the discovery rule.
