In a Westlaw Today article, health care partner Christine Moundas and associate Gideon Zvi Palte examined the U.S. Department of Health and Human Services' (HHS) final rule under the 21st Century Cures Act establishing information blocking disincentives for health care providers found to have interfered with access, exchange, or use of electronic health information (EHI).
The Final Rule's disincentives will become effective on July 31, 2024. In addition, the HHS Office of the National Coordinator for Health Information Technology (ONC) will publish information blocking determinations, disincentives, and penalties that have been imposed to inform the public about how and where information blocking is occurring.
The Final Rule represents a continuation of actions by HHS agencies to advance interoperability and support the access, exchange, and use of EHI.
