In articles for The New York Times and Responsible Investor, litigation & enforcement partner Rob Skinner noted that anti-ESG laws across several states are based on a false premise that asset managers are pursuing a social agenda rather than trying to maximize long-term returns.
Rob told The New York Times, “The risks imposed by climate change and other so-called ESG risks are fundamental material financial risks that asset managers ignore at their peril.”
In Responsible Investor, Rob said about the recent suit against the state of Texas by The American Sustainable Business Council that it’s “refreshing” to see the First Amendment challenge and noted that “all of these statutes have been poised for this challenge.”
The state of Texas “has not been shy about the fact that it is protecting the oil and gas industry on the basis of asset managers’ expressed viewpoints about climate risk,” Rob said.
