In an article for The New York Times, litigation & enforcement partner Rob Skinner commented on a lawsuit filed by the American Sustainable Business Council against the state of Texas. The suit argues that laws like S.B. 13, prohibiting state entities from placing investments with firms that include environmental principles in their investment strategies, violate the First Amendment.
Rob noted that investment professionals routinely review a company’s environmental, social and corporate-governance policies as part of their risk analysis.
“The risks imposed by climate change and other so-called E.S.G. risks are fundamental material financial risks that asset managers ignore at their peril,” said Rob.
