In a Managing Intellectual Property article, IP litigation partner Matt Rizzolo discussed the effects of mandatory litigation funding disclosures.
The Judicial Conference's Advisory Committee on Civil Rules, a US governmental committee, recently agreed to consider whether there should be a federal rule requiring the disclosure of third-party funding in litigation.
Matt explains this could be a treasure trove of data for litigators. It would allow them to see who was funding various cases and who was involved in what industries.
"If you end up in situations where some of these funding entities have to disclose that they're involved, that presents an area of potential counter leverage – whether that's bringing defendants' own lawsuits against these entities – or just in the court of public opinion,” said Matt.
