In National Law Journal, Jane Willis Examines Focus on Health Care Antitrust Enforcement

In a National Law Journal and Law.com article, antitrust partner Jane Willis analyzed the impact of the Presidential election on the composition of the Federal Trade Commission and the likelihood that federal antitrust health care scrutiny will continue.

The article notes that Jane and a Ropes & Gray team represented private equity firm Welsh, Carson, Anderson & Stowe successfully in antitrust complaints brought by the Federal Trade Commission and a separate class action lawsuit brought against WCAS and portfolio company U.S. Anesthesia Partners for damages.

The FTC accused WCAS of creating U.S. Anesthesia Partners "for the purpose of rolling up anesthesia practices in Texas," and law firm Lieff Cabraser mirrored those allegations in a class-action lawsuit. Federal judges recently dismissed these claims against Welsh Carson. The class action lawsuit was dismissed because Welsh Carson was incapable of conspiring with its own portfolio company for the purpose of the antitrust laws, nor was Welsh Carson vicariously liable for damages under principles of corporate separateness.
