In an article for Bloomberg Law, litigation & enforcement partner Amy Kossak discussed potential implications of the upcoming U.S. Supreme Court ruling on Wisconsin Bell Inc. v. United States ex rel. Heath. Wisconsin Bell argues for the dismissal of a False Claims Act suit alleging fraud because the suit does not involve government funds.
Amy noted that the distinction that Wisconsin Bell has drawn between public and private funds is “a clean line” that the Supreme Court might find appealing. She added that while a win for Wisconsin Bell would likely impact a "small fraction of cases" due to the uncommon nature of the funding mechanism at issue, it would be "significant for the telecommunications industry," which relies heavily on such funding programs.
