In the American Bar Association’s July/August 2026 Trends newsletter, environmental partner Peter Alpert analyzed Connecticut’s new program for imposing remedial liability on the owners or operators of contaminated land.
The new program replaces the Transfer Act, Connecticut’s 1980s-era law regulating the identification and remediation of contaminated land. Although the new concept aligns Connecticut with many other states, the program is to be implemented in a way that could pose unique and significant challenges to the design and execution of environmental due diligence in real estate and corporate transactions, Peter wrote.
