The Virginia Journal of Law & Technology,a law review published by the University of Virginia, has published an article written by Michael R. Mattioli, as associate in the New York office of Ropes & Gray. In the article, "Opting Out: Procedural Fair Use," Mattioli looks at Google's controversial plan to scan thousands of copyrighted books as part of a massive new digital indexing service. While Google provided an "opt-out" procedure for authors who did not want their books scanned, two major authors groups sued Google, asserting that the procedure resulted in an unfair burden.
