Earlier this week, the U.S. Supreme Court unexpectedly granted certiorari in a False Claims Act (“FCA”) case that asks the Court to determine whether the government may dismiss a qui tam action if the government initially declines to intervene in the case and, if so, what standard of review a court should apply to the government’s dismissal request.
