U.S. asset managers need to be mindful of the sanctions regime governed by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”) – both when they make investments in securities on behalf of their clients and when they take on new clients (or when funds accept new investors). In light of the sanctions being imposed in connection with the recent events in Ukraine and Russia, both in the U.S. and European Union, it is important that asset managers understand their obligations under OFAC and the EU rules, and how to satisfy those obligations when new sanctions are imposed.
