Litigation and Enforcement Attorneys Join ACI’s 10th Annual Advanced Forum on False Claims and Qui Tam Enforcement in New York

Litigation and enforcement DC-based partner, Doug Hallward-Driemeier, spoke at ACI’s 10th Annual Advanced Forum on False Claims and Qui Tam Enforcement in New York examining “SCOTUS Watch: The Latest in the Debate Over DOJ’s Dismissal Authority and the Requisite Pleading Standard for False Claims Act Qui Tam Claims.”

Doug was joined by co-panelists Darrell Valdez (U.S. Attorney's Office, District of Columbia), Roderick Thomas (Wiley Rein LLP), and Claire Sylvia (Phillips & Cohen LLP). The panel analyzed the circuit court split on DOJ’s dismissal authority, leading to the U.S. Supreme Court’s grant of certiorari in United States ex rel. Polansky v. Executive Health Resources, Inc., and the three pending petitions for certiorari seeking Supreme Court clarity on the level of particularity required under Rule 9(b) to plead a claim under the FCA. The panelists also discussed the Supreme Court’s issue on the excessive fines clause.

Litigation and enforcement Boston-based partner, John Bueker, also attended the Forum and gave the opening remarks during the Ropes & Gray’s-hosted networking luncheon.
