HCA Prevails in Antitrust Case

Ropes & Gray obtained summary judgment of all claims brought against clients Hospital Corporation of America (HCA) and Good Samaritan Hospital in Fox v. Good Samaritan L.P. C 04-0874 RS, in the U.S. District Court for the Northern District of California. In a 20-page written order issued on March 29, Judge Richard Seeborg granted judgment to all defendants, obviating a jury trial that had been scheduled to begin on May 3, 2010. The plaintiff had contended that denial of his privileges enabled the hospital and a rival clinical practice to monopolize PICU services, in violation of federal and state law.
