Boston-based government enforcement partner and former federal prosecutor JoshuaLevy is quoted in a July 30 NPR report titled, “Will Whitey Bulger Testify?” Commenting on whether the former mobster will take the stand in his own defense, Mr. Levy explained there would “be a lot riding on how much leeway Mr. Bulger would get,” and noted, “You can't just go up on the stand and give a monologue about your life and who you want to settle scores with. It has to be relevant evidence. And the judge is the gatekeeper on what evidence the jury hears. And when you limit defense testimony, you create appeal issues.”
