The Harvard Law School Forum on Corporate Governance and Financial Regulation published an article on Dec. 14, written by hedge fund partner Leigh Fraser (Boston), hedge funds counsel Anna Lawry (London) and Molly Moore (Washington, D.C.). The article, title “New ISDA Protocol Limits Buy-Side Remedies in Financial Institution Failure,” details key features of the 2014 Resolution Stay Protocol designed by the International Swaps and Derivatives Association, Inc. (ISDA) and adopted voluntarily by major global banks, examining how these provisions will affect entities on the buy-side of deals under the ISDA Master Agreement.
