Intellectual Property Litigator Quoted in Bloomberg BNA and Law360 on Impact of Defend Trade Secrets Act Passage in U.S. House

On April 27, Bloomberg BNA’s Patent, Trademark and Copyright Journal quoted intellectual property litigation partner Peter Brody (Washington, D.C.) on the U.S. House of Representatives passing the Defend Trade Secrets Act (DTSA). The House bill passed 410- 2 and now moves to President Obama, who has indicated that he will sign it. The DTSA bill passed the U.S. Senate unanimously 87-0 on April 4.

Mr. Brody explains that IP attorneys, who do the vast majority of their work in federal courtrooms, will be attracted to a single national standard for trade secrets cases. But he cautions that the “extraordinary circumstances” bar for seizure will likely be difficult to meet.

In an April 27 Law360 article explaining the DTSA, he cites the sparing use of ex parte seizure and how companies may protect their intellectual property using the new federal trade secret law.
