Intellectual property litigation partner Peter Brody (Washington, D.C.) co-authored an Intellectual Property Magazine article on the new Defend Trade Secrets Act (DTSA), a bill that passed the U.S. Senate and U.S. House of Representatives. The DTSA will be sent to President Obama for his signature, creating the first federal civil remedy for trade secret misappropriation.

They explain that while there is some overlap between the scope of the DTSA and those remedies currently available in many state courts, the bill offers new, robust forms of relief, including a provision permitting ex parte seizure orders to prevent further dissemination of the trade secret information. The DTSA also contains certain protections for employee mobility. (Subscription required)
