Shanghai managing partner Geoffrey Lin discussed challenges and strategy for global companies seeking to protect their intellectual property in China in an Oct. 12 Corporate Counsel article.
Mr. Lin notes that in China’s young court system some think that damages are not commensurate with the scale of potential harm in IP infringement cases. He explains that having a China unified appellate IP court is something he anticipates in the next few years. He advises global companies and their legal departments to mitigate copyright, trade secret and patent IP risks in China by keeping control over some component of their technology.
